NRG Energy: ECOtality lawsuit without merit

NRG Energy has filed its opposition to ECOtality’s Petition for a Writ of Mandate. Last month, ECOtality filed a lawsuit to halt the implementation of an agreement between the California Public Utilities Commission (CPUC) and New Jersey-based NRG Energy which it claimed would create a monopoly in the electric vehicle (EV) charging station market.

In its filing, NRG claims that ECOtality’s challenge to the Settlement Agreement is without merit because ECOtality has failed to demonstrate that the proposed Settlement Agreement violates California law.

NRG rebuts that the $102.5 million earmarked in the Settlement for its EV Charging Station Project is a subsidy or a diversion of ratepayer refunds. NRG says this represents the total value of its investment in infrastructure that, together with the $20 million in cash, NRG has agreed to provide to the CPUC in exchange for settling the outstanding claims.
